Tree Cutting & Maintenance Policy The County of Passaic shall be responsible for the removal and disposal of trees located within the County Right-of-Way which are deemed to be dead, diseased or dying and beyond recovery, blown down or destroyed due to a windstorm or other natural disaster over which humans have no control. In cases where a municipality has an established ordinance or policy placing responsibility on an individual or entity other than the municipality to maintain trees, that ordinance or policy shall govern. Where a municipality, organization, group or abutting or nearby property owner requests permission to plant trees within the County Right-of-Way, the County of Passaic may require that it obtain the necessary Right-of-Way entry permits and bear the cost of planting the tree(s). Where a municipality, organization, group or abutting or nearby property owner requests permission to plant trees within the County Right-of-Way, the County of Passaic may condition approval upon an agreement by the municipality or organization to maintain said tree(s) at its own expense. There shall be no cutting of trees due to uplifting of sidewalks. The County of Passaic did not plant these trees, nor were the sidewalks constructed or located by the County of Passaic, and therefore, is not the County’s responsibility.
