INTRODUCTION - Pursuant to the New
Jersey Solid Waste Management Act (N.J.S.A. 13:1E - 1 et
seq) and specifically amendments to the Act found
in N.J.S.A. 13:1E-99.11 et seq, counties were
required to amend their District Solid Waste Management
Plan to include a District Recycling Plan . The Passaic
County Board of Chosen Freeholders adopted such an
amendment , The Passaic County Recycling Plan, on
November 30, 1987.
In accordance with the requirements
of N.J.S.A. 13:1E-1 et seq the Passaic
County Recycling Plan was approved, with modification,
April 29, 1988, by the Commissioner of the New Jersey
Department of Environmental Protection.
The modification required by the
New Jersey Department of Environmental Protection
expressed the concerns of the Division of Solid Waste
Management, Bureau of Solid Waste and Resource Recovery,
and the Office of Recycling as to specific provisions in
the County Plan. The provisions commented upon were:
1) The establishment of an
intermediate processing facility
2) Procedures for adopting major
and minor modification of the Recycling Plan
3) Enforcement of the Recycling
Plan
4) Leaf composting facilities in
four (4) municipalities
5) Designation of a new District
Recycling Coordinator
It is the intent of this amendment
to address these provisions and thereby modify
accordingly the Passaic County Recycling amendment.
RECOMMENDATIONS
1) THE ESTABLISHMENT OF AN
INTERMEDIATE PROCESSING FACILITY
As outlined in the Passaic County
Recycling Plan, Passaic County favors the commingling of
certain recyclables (i.e. glass, food and beverage
containers, aluminum cans and other types of food and
beverage containers).
Passaic County also realizes the
need for an intermediate facility where commingled food
and beverage containers may be brought for further
separation into recyclable components.
In the County Recycling Plan,
facilities operated by the in-county recycling industry
are listed on pg. 36 and 37 (sec. 9). Passaic County now
adds W.P.A.R. Inc., West Paterson, to that list as an
intermediate processing facility for commingled food and
beverage containers.
This facility has been available to
municipalities for approximately one (1) year and has
fully accommodated the County market for commingled food
and beverage containers.
Upon notification that the current
facility can no longer meet the market demand, or must
close for other considerations, within ninety (90) days
the county will issue its request.
If within 6 months the in-county
recycling industry does not respond, proposals of the
recycling community at large will be invited.
In the interim, it will be
incumbent upon the municipalities to separate materials
so they are acceptable for sale in existing markets.
2) PROCEDURES FOR ADOPTING MAJOR
AND MINOR MODIFICATIONS OF THE RECYCLING PLAN
N.J.S.A. 13:1E - 99.13d provides
for a modification procedure to be set forth in each
District Recycling Plan. Modification of the Passaic
County Recycling Plan shall be accomplished by the
following procedures.
A) MAJOR MODIFICATIONS shall
be adopted as amendments to the Solid Waste Management
Plan and follow guidelines generally set forth in
N.J.S.A. 13:1E-let seq and specifically in Passaic County
Recycling Plan (p. 34, sec. 6).
A modification shall be considered
major if it designates or incorporates a new or newly
expanded recycling center or facility into the Plan;
identifies specific materials to be added to or deleted
from the list of designated materials to be recycled by
all Passaic County municipalities; allocates funds made
available to the county under the N.J. State Resource
Recovery Investment Tax Fund to various recycling
purposes, or has county-wide or long term impact on
recycling programs or projects in Passaic county.
B) MINOR MODIFICATIONS shall
be included in the plan upon presentation to the Passaic
County Solid Waste Advisory Council, at a meeting for
which public notice has been given no less than ten (10)
days prior to the meeting and upon affirmative resolution
by the Passaic County Board of Chosen Freeholders.
